Anthony B. Fioravanti is a trial lawyer and commercial litigator trusted by businesses and individuals across Massachusetts and beyond. Regularly appearing before state and federal courts, the Massachusetts Appeals Court, the United States Court of Appeals for the First Circuit, and in arbitration and mediation proceedings, Anthony concentrates his practice on the cases where the stakes are highest and the relationships have broken down completely — contentious construction disputes involving contractors, owners, and developers, and the full spectrum of business divorce litigation, including shareholder disputes, partnership breakdowns, LLC member conflicts, trade secret and restrictive covenant enforcement, and fiduciary duty claims. When business partners cannot agree on how to move forward, Anthony’s clients know who to call.

Anthony brings a distinctive perspective to commercial litigation developed over two decades of representing both plaintiffs and defendants across all sides of complex disputes. That dual-sided experience — understanding not only what his clients need to prove, but how opponents will respond — informs every strategy he builds. He is known for pragmatic, outcome-focused advocacy that keeps clients’ business objectives at the center of even the most adversarial disputes, whether the goal is to dismantle an opponent’s position through aggressive motion practice or to achieve a resolution that protects long-term interests.

His construction practice covers the full spectrum of project disputes: payment claims, Prompt Pay Act enforcement, construction defect litigation, prevailing wage and False Claims Act exposure on public projects, and commercial and residential contractor-owner breakdowns. Anthony has written extensively on developments in Massachusetts construction law and has contributed to Massachusetts Construction Law and Litigation, MCLE’s definitive practitioner resource for construction lawyers in the Commonwealth. He has also moderated MCLE programs on construction litigation, and counseled clients on supply chain risk management and tariff-related contract exposure.

Anthony is recognized by peers and clients for his tenacity, intelligence, and diligence — qualities that have earned him consecutive recognition in Massachusetts Super Lawyers and more than a decade on the Rising Stars list. As a Partner at Cole Law Partners, he joins a team that shares his commitment to boutique, high-stakes litigation and to delivering decisive results without the overhead of a large firm.

When not practicing law, Anthony spends time with his wife Kate and their three boys. Anthony is an avid soccer fan and can be found on the pitch either playing or coaching. Otherwise, he’s probably filling the bird feeders.

Representative Experience

  • Secured an Appeals Court victory in a closely held LLC membership dispute, successfully moving to disqualify opposing counsel who simultaneously represented both the LLC and an adverse member — establishing that the LLC holds interests distinct from its member-managers when allegations of self-dealing are at issue.
  • Analyzed and reported on a landmark Superior Court decision awarding a $4,000,000 judgment to a general contractor in a Prompt Pay Act enforcement dispute, among the first Massachusetts court opinions to strictly apply G.L. c. 149, § 29E’s procedural requirements to owners rejecting payment requisitions.
  • Reported on and counseled clients regarding the first Massachusetts Appeals Court decision to interpret the Prompt Pay Act’s good faith certification requirement for rejection of payment applications — a foundational development for payment disputes on private projects over $3 million.
  • Counseled construction clients on prevailing wage compliance and Massachusetts False Claims Act exposure on public projects, where a prime contractor’s failure to monitor subcontractor compliance can result in multiple damages far exceeding underlying unpaid wages.
  • Represented clients in complex business-to-business contract disputes, shareholder and partnership conflicts, and trade secret and restrictive covenant litigation across multiple industries.
  • Co-presented with the Association of Corporate Counsel on commercial litigation strategy and risk management.
  • Contributed to Massachusetts Construction Law and Litigation (MCLE), the leading practitioner treatise on construction law in the Commonwealth, alongside CLP’s own Drew W. Colby.
  • Moderated MCLE webcast programs on bringing and defending construction claims in Massachusetts.
  • Secured a $2.7 million summary judgment award under the Massachusetts Prompt Pay Act on behalf of a general contractor in a payment dispute against a project owner.
